PRIVACY POLICY FOR MYKIBO

MyKibo is dedicated to protect your privacy. We treat all personal data provided by you in a strictly confidential manner, and will use your personal data in accordance with this Policy. This Policy showcases how we may handle the collection, usage, disclosure, processing and management of your personal data and applies to all personal data that you provide to us and the personal data we possess about you.

By dispensing to us with your personal data, you agree to our collection, usage and disclosure inclusive of transfer of your personal data according to this Policy. Please REFRAIN from providing us with your personal data if you do not consent to this policy.

Throughout our business operations, we may collect, use, disclose and process personal data, on behalf of third parties. In such circumstances, we are mandated to comply with their instructions in relation to such personal data and as such, this Policy shall not apply.

A. PERSONAL DATA

i) What is personal data?

“Personal data” is all data related to an identified or identifiable person. Examples of personal data include name, address, identification numbers, photographs, account details, telephone numbers and email address.

ii) Voluntary provision of personal data

Your provision of personal data to us is completely voluntary. Nevertheless, if you choose not to provide us with the personal data we require, then it will be difficult for us to contact you or supply you with any services you might need form us.

iii) Providing personal data belonging to others

In the event that you provide to us the personal data of anybody other than yourself, you warrant that you have informed him/her of the purposes for which we are collecting his/her personal data and that he/she has agreed to your disclosure of his/her personal data to us for such purposes.

iv) Accuracy and Completeness or personal data

You must endeavor that all personal data that you provide is accurate, true, and complete.

v) Collection of Personal Data

Generally, we may collect your personal data when you:

  1. Register to use our platform;
  2. Register for any of our products or services;
  3. Accept to work with any of our partners;
  4. use any of our products or services;
  5. Submit any data or document to us for processing;
  6. Perform an online transaction on any of our Platforms;
  7. Report a problem with any of our Platforms;
  8. Fill in our surveys and provide feedback;
  9. Contact us whether through email, telephone, or writing; and/or
  10. Submit your personal data to us for any other reason.

B.PURPOSES FOR COLLECTION, USE OR DISCLOSURE OF PERSONAL DATA

i) Service related purposes:

Generally, our collection, usage or disclosure of your personal data is often for the following service related purposes:

  1. to manage your engagement with us;
  2. to provide you with the products and services that you have requested, including products and services from third party service providers;
  3. to assist you with your enquiries;
  4. to contact you for feedback after the provision of our products and services; and
  5. to keep you updated on our products and services.

ii) Business purposes:

We may also use your personal data for purposes connected or relevant to our business, such as:

  1. Complying with our legal obligations and requirements;
  2. Enforcing obligations owed to us by our partners or any other entities;
  3. Accounting, risk management and record keeping;
  4. Research into the development of new products and services or improvement of our existing products and services;
  5. Carrying out research, planning and statistical analysis; and
  6. Staff training.

iii). Marketing purposes:

We may use your personal data for marketing purposes of our products and services and services offered by our partners and business counterparts.

While using your personal data for marketing purposes, we might send marketing messages to you in various modes such as to email, direct mailers, facsimile, short messaging service, telephone calls, and other mobile message services. We will only send marketing messages to your Rwandan telephone number if you have one via SMS, telephone calls and other mobile messaging services, if we have your clear and unambiguous consent to do so.

iv). Processing purposes:

We may collect, use or disclose personal data as a data intermediary on behalf of another company or our partners. In such instances, we will simply be processing the personal data collected from you on behalf of such company.

v). Contacting you:

While using your personal data to contact you for the above reasons, we might contact you through/via post, e -mail, SMS, telephone or any other means.

C. DISCLOSURE OF INFORMATION

We will not sell, share, or rent your information to others except to our staff and to trusted third parties and affiliates when we need to share the information to provide services you have requested. We may also share your information to enable a trusted third party or affiliate to provide services to us, and then only to provide those services. We limit as commercially reasonable their access and use of your Personal Information to that which is necessary to provide these services to us. Without limiting the above, we will share your Personal Information with third parties only in the ways that are described in this Privacy Policy.

We may also be required by law to disclose your Personal Information in response to a subpoena, court order, or a request for cooperation from law enforcement or other governmental agency globally. Your Personal Information may also be shared when we believe disclosure is necessary in connection with efforts to investigate, prevent, or take other action regarding actual or suspected illegal activity or other wrongdoing, to protect and defend the rights, property or safety of My Kibo, our users, or others. We will use commercially reasonable efforts to make you aware of the disclosure of your Personal Information contrary to the terms set forth in this Privacy Policy (e.g., in the event of any material security breach).

D. RETENTION OF PERSONAL DATA

We retain your personal information for as long as we have an ongoing legitimate business need to do so, to provide services or products to you as required or permitted by applicable laws. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise it, or if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. How long your data is kept for will also depend on how you use our platform (for example if you are logged in as a member or you are visiting our platform as a guest) and what the information you provide to us is used for. For example, if you are a registered member, certain data will be retained for a length of time following termination or deletion of your account, in order to comply with applicable laws or in case of disputes. In other instances, the period of retention may be determined according to your activity on the Platform or to comply with a specific arbitration period/resolve a dispute

E. THIRD PARTY LINKS AND POLICIES

Our platform may contain links to other websites owned and operated by third parties and/or affiliates. These third parties and affiliates may collect information from you. These affiliates and third parties and their computer servers may be located in the Republic of Rwanda, the United Kingdom, or in other countries. We do not control, and are not responsible for, the privacy and security practices of any third parties or affiliates. We strongly recommend that you review the privacy and security policies of all third parties and affiliates to determine how they handle information they may collect about you. To the extent their privacy policies conflict with this Privacy Policy, their privacy policies shall control.

F. RIGHTS AS A DATA SUBJECT

Subject to possible restrictions under national law, as a data subject, you have the right to access, rectify, erase, restriction of processing and data portability with regard to your personal data. Additionally, you can withdraw your consent and object to our processing of your personal data on the basis of our legitimate interests. Nevertheless, we may not be in a position to continue to provide our products or services to you if you withdraw your consent for purposes that are necessary for the provision of such products or services. You can also lodge a complaint with a supervisory authority.

G. COOKIES & SIMILAR TECHNOLOGIES

When you use our Services, we and selected third parties may use cookies and similar technologies to provide you with a better, faster and safer user experience or to show you personalized advertising. Cookies are small text files that are automatically created by your browser and stored on your device when you use the Services.

H. DISPUTE RESOLUTION

All disputes arising under this Policy shall be governed by and interpreted in accordance with the laws of Rwanda, without regard to principles of conflict of laws. The parties to this Policy will submit all disputes arising under this agreement to arbitration at Kigali Arbitration Center (KIAC), before a single arbitrator. The arbitrator shall be selected by application of the rules of KIAC, or by mutual agreement of the parties, except that such arbitrator shall be an attorney admitted to practice law in Rwanda. No party to this Policy will challenge the jurisdiction or venue provisions as provided in this section. I. AMENDMENTS AND UPDATES

We may amend this Policy from time to time and will make available the updated policy on our platform. Each time you use our Platforms, or contact, interact or transact with us, you acknowledge and agree that our latest privacy policy shall apply to you.
